Information clause for contractors/representatives/authorized persons and contact persons designated for cooperation with ZW Automation sp. z o.o.
We inform you that, in accordance with the General Data Protection Regulation (hereinafter “GDPR”):
I. Data Administrator
The administrator of your personal data is ZW Automation Sp. z o.o., ul. Fabryczna 10, 53-609 Wrocław, NIP: 8943137171, REGON 382379578, KRS 0000767867 (hereinafter referred to as the “Administrator”).

III. Purposes and legal bases of processing
We will process your personal data for the purpose of:
- implementing cooperation between the Administrator and you as a party to the contract, an entity you represent, or who has designated you as a contact person, in connection with the implementation of cooperation (legal basis for processing: contract – Art. 6(1)(b) GDPR);
- fulfilling the legal obligations of the Administrator related to cooperation, e.g., maintaining accounting records (legal basis for processing: legal obligation – Art. 6(1)(c) GDPR);
- maintaining business relations between the Administrator and you as a party to the contract, an entity you represent, or who has designated you as a contact person, in connection with the implementation of cooperation (legal basis for processing: legitimate interest of the Administrator – Art. 6(1)(f) GDPR);
- establishing, asserting, and defending claims related to the implementation of cooperation (legal basis for processing – Art. 6(1)(f) GDPR);
- sending email notifications about interesting offers or content, which in some cases may contain commercial information (newsletter service) – legal basis Art. 6(1)(a) GDPR.
Providing personal data is voluntary; however, refusal to provide it may result in the inability to achieve the above purposes of the Administrator.
- Source of data
If you are not a party to the contract (i.e., you did not provide your data directly to the Administrator), the Administrator received your personal data from the entity you represent or who designated you as a contact person, in connection with the implementation of cooperation between the parties. Accordingly, the Administrator processes your data to the extent necessary to carry out this cooperation, in particular: first name, last name, position, business contact details. - Rights related to data processing
In accordance with GDPR, you have the right to:
• Request access to your personal data;
• Obtain a copy of the processed data;
• Correct the data;
• Delete or restrict the processing of data;
• Transfer the data;
• Withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal).
You have the right at any time to object to the processing of data processed on the basis of Art. 6(1)(f) GDPR, indicated above (i.e., purposes and legal bases of processing).
Additionally, if you consider that the processing of personal data violates GDPR, you have the right to lodge a complaint with the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw.
Requests in this regard should be sent to the email address: biuro@zwautomation.pl. To ensure that you are authorized to submit a request, we may ask for additional information to verify your identity.
- Data retention period
We will process the data for the period necessary to achieve the above purposes, in particular, for the duration of cooperation, its settlement, and for the period required by law to retain the data, as well as for the period necessary to secure potential claims – in accordance with the statute of limitations under applicable law.
In cases where data is processed on the basis of our legitimate interest (legal basis: Art. 6(1)(f) GDPR), we process it until you submit an effective objection to such processing.
If the basis for processing is the voluntary consent you have given, the Administrator will process your personal data until you effectively withdraw your consent.
VII. Data recipients
The Administrator may disclose processed data to:
• its employees and collaborators who, within a specific, limited authorization, may have access to the data in connection with their official duties;
• external entities to whom the Administrator has entrusted the processing of personal data, in particular: providers of technical services (i.e., IT services, IT system providers), etc.;
• authorized entities, to the extent and under the rules specified by law.
VIII. Data transfer
Personal data will generally not be transferred outside the European Economic Area (hereinafter: “EEA”). However, considering the provision of services by our subcontractors for IT and telecommunication support and IT infrastructure, the Administrator may commission certain IT activities or tasks to recognized subcontractors operating outside the EEA, which may result in transferring your data outside the EEA.
According to the European Commission’s decision, certain recipient countries outside the EEA provide an adequate level of personal data protection in accordance with EEA standards. For recipients in countries not covered by the European Commission’s decision, to ensure an adequate level of protection, the Administrator concludes agreements with data recipients based on standard contractual clauses issued by the European Commission in accordance with Art. 46(2)(c) GDPR.
- Automated decision-making
The Administrator does not make decisions in an automated manner, including profiling within the meaning of Art. 22 GDPR. - INFORMATION CLAUSE FOR RECRUITMENT PARTICIPANTS

- Purposes and legal bases of processing
We will process your personal data for the purpose of:
• assessing the possibility of your employment or cooperation in the scope indicated in the advertisement (legal basis for processing: actions aimed at entering into a contract – Art. 6(1)(b) GDPR);
• carrying out the recruitment process using additional personal data provided by the applicant, e.g., photo, interests, etc. (legal basis for processing: voluntary consent – Art. 6(1)(a) GDPR, Art. 9(1)(a) GDPR);
• conducting future recruitment processes involving the applicant (legal basis for processing: voluntary consent – Art. 6(1)(a) GDPR);
• fulfilling the legal obligations of the Administrator related to the recruitment process (legal basis for processing: legal requirement – Art. 6(1)(c) GDPR);
• establishing, asserting, and defending against potential claims related to the recruitment process (legal basis for processing – Art. 6(1)(f) GDPR);
• sending our newsletter, informing you about offers, sending invitations, and other direct marketing communication using email, notifications, online messengers, phone calls, text messages, and traditional correspondence.
Providing personal data is voluntary; however, refusal may result in the inability to achieve the purposes of processing indicated above by the Administrator.
Consent to the processing of personal data for sending marketing information to the provided email address may be withdrawn at any time by contacting the Administrator. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.
XII. Rights related to processing
In accordance with GDPR, you have the right to:
• request access to your personal data;
• obtain a copy of the processed data;
• correct the data;
• delete or restrict the processing;
• transfer the data;
• withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal).
You have the right at any time to object to the processing of data processed on the basis of Art. 6(1)(f) GDPR, indicated above (i.e., purposes and legal bases of processing).

XIII. Data retention period
We will process data for the period necessary to achieve the above purposes, in particular, for the duration of the recruitment or cooperation process (i.e., 12 months from the day you submit application documents, unless you consented to participate in future recruitment/cooperation – in such cases, your submitted documents will be stored for 3 years from the day of submission), for the period required by law, and for the period necessary to secure potential claims – in accordance with the statute of limitations under applicable law.
Where data is processed based on our legitimate interest (legal basis: Art. 6(1)(f) GDPR), we process it until you submit an effective objection.
Where processing is based on your voluntary consent, the Administrator will process your personal data until you effectively withdraw your consent.
